Terms and Conditions – SwiftCall

These Terms and Conditions govern the use of SwiftCall services and communication systems. By interacting with SwiftCall or providing contact information through SwiftCall or participating client businesses, you agree to these Terms.

Service Description

SwiftCall provides AI-powered communication automation that enables businesses to send appointment confirmations, reminders, scheduling updates, and service-related notifications. SwiftCall communicates with users on its own behalf and on behalf of client businesses.

Consent to Communications

SMS consent is obtained through one of two methods:

- Web form opt-in: by affirmatively checking the SMS consent checkbox on our scheduling page at swiftcall.org/get-started.
- Verbal opt-in: by providing spoken consent during a phone call with SwiftCall's AI voice agent, after the agent discloses the business name, the types of messages that will be sent, that message and data rates may apply, and how to opt out. Verbal consent is captured in the call audio and transcript.

By opting in through either method, you consent to receive SMS messages from SwiftCall related to appointment confirmations, reminders, scheduling updates, and service-related notifications.

- Message frequency may vary (typically 2-6 messages per service interaction)
- Message and data rates may apply
- Reply STOP to opt out at any time
- Reply HELP for assistance
- Consent to receive messages is optional and is not a condition of purchase

We do not sell, rent, or share your mobile number, SMS opt-in information, or consent records with third parties for marketing purposes.

Acceptable Use

Users agree not to misuse SwiftCall services, interfere with system operations, or attempt unauthorized access.

Client Responsibility

Businesses using SwiftCall services are responsible for obtaining lawful consent from individuals prior to communication and for complying with all applicable laws, including the TCPA and CTIA Messaging Principles and Best Practices.

Limitation of Liability

SwiftCall is not liable for delays, delivery failures, or damages resulting from telecommunications carriers, mobile carriers, or third-party service providers.

Third-Party Platforms

SwiftCall may integrate with third-party systems including messaging carriers (Twilio), scheduling platforms (Google Calendar), video conferencing providers (Zoom, Google Meet), and data storage tools (Google). Use of those services is subject to their respective terms.

Service Availability

Services are provided on an "as available" basis without guarantees of uninterrupted operation.

Modifications

SwiftCall reserves the right to modify services or these Terms at any time. Changes will be posted on this page with an updated Effective Date.

Governing Law

These Terms shall be governed by the laws of the State of Illinois and applicable United States federal regulations.
